1. Scope of Application
(1) The following General Terms and Conditions govern the use of the petition platform "Voact", operated by:

(2) These Terms apply to all users of the petition platform, in particular:
- Petition creators ("petitioners")
- Signers ("supporters")
- Website visitors
(3) By using the platform, you expressly acknowledge these Terms.
2. Purpose of the Platform
(1) The platform enables users to create, publish and support petitions.
(2) The aim of the platform is to promote civic engagement, social participation and digital participation.
(3) The platform serves exclusively civil society purposes and is non-profit.
3. Registration and User Account
(1) To create a petition, registration with a valid email address is required.
(2) Users are obliged to provide correct and complete information.
(3) A user account is not transferable.
(4) The operator is entitled to reject registrations or block accounts for good cause.
4. User Responsibility
(1) Users are solely responsible for all content they publish on the platform.
(2) In particular, petitioners are liable for the accuracy, legality and completeness of the petitions they create.
(3) The operator does not adopt the content of the petitions as its own.
(4) Users must not post content that:
- is illegal, insulting or defamatory
- violates personal rights or copyrights
- is racist, extremist or discriminatory
- constitutes commercial advertising
(5) In case of violations, the operator reserves the right to delete content without prior notice or block user accounts.
5. Operator Responsibility (Host Provider)
(1) The operator merely provides the technical infrastructure.
(2) According to § 10 TMG, the operator is not obliged to actively monitor stored content.
(3) Upon specific notice of illegal content, the operator will review and possibly remove it.
(4) Liability for third-party content only exists from knowledge of a clear legal violation.
6. Signing Petitions
(1) Supporters can sign petitions publicly or anonymously.
(2) Providing a valid email address is necessary to prevent abuse.
(3) Multiple votes per person are prohibited.
(4) Supporters can revoke their signature at any time.
7. Data Handling and Sharing
(1) The processing of personal data is carried out exclusively in accordance with the privacy policy.
(2) Data sharing with third parties only occurs:
- after express consent of the user
- to government agencies, if legally required
- to technical service providers within the scope of order processing
(3) Petitioners only receive supporters' data if they have expressly given their consent.
8. Deletion and Deactivation of Content
(1) Petitioners can delete their petitions at any time.
(2) The operator is entitled to remove petitions if they:
- violate legal provisions
- contain false statements of fact
- incite violence
- violate these Terms
- are unsuitable for the purpose of the platform
(3) Recovery of deleted content is not possible.
9. Platform Availability
(1) The operator strives for high technical availability of the platform, but cannot guarantee permanent or uninterrupted accessibility.
(2) Maintenance work may lead to temporary restrictions.
(3) The operator is not liable for failures due to force majeure, technical problems of third parties or necessary maintenance work.
10. Liability
(1) The operator is not liable for the content of the petitions.
(2) The petitioner alone is liable for damages resulting from incorrect, illegal or incomplete petition content.
(3) The operator is only liable for damages based on gross negligence or intent.
(4) Liability for slight negligence is excluded – except for injury to life, body or health.
11. Copyright
(1) Users may only upload content for which they have the necessary rights.
(2) By publishing a petition, the user grants the operator a simple right of use to display it on the platform.
(3) Copyright remains with the respective user.
12. Prohibition of Abuse and Manipulation
Users are prohibited from:
- submitting votes automatically
- creating fake accounts
- exploiting technical vulnerabilities
- manipulating content or falsifying results
- using false identities
Violations lead to immediate blocking.
13. Termination / End of Use
(1) Users can delete their account at any time.
(2) The operator can terminate use with reasonable notice or block the account.
(3) Important reasons for immediate blocking include in particular legal violations, abuse or false information.
14. Changes to Terms
The operator reserves the right to adjust these Terms if necessary. Significant changes will be communicated to users via email or notice on the website.
15. Final Provisions
(1) The law of the Federal Republic of Germany applies.
(2) Place of jurisdiction for disputes is – if permissible – Leverkusen.
(3) Should any provision of these Terms be invalid, the validity of the remaining provisions remains unaffected.
